Terms of Service

By browsing houseforrentkenya.com, creating an account, listing a property, booking a concierge service, or otherwise using the House for Rent Kenya ("HFR", "we", "us") platform, you agree to be bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, please do not use our website or services. We may update these Terms from time to time; the latest version is always the one published on this page, with the "Last updated" date shown above.

HFR is a Kenyan rental marketplace operated from Westlands, Nairobi, Kenya. We provide three core services: (a) document-verified rental listings, (b) concierge property search and walkthroughs (especially for diaspora members), and (c) full-service property management for landlords.

We are not a real-estate agency in the traditional Kenyan sense and we are not a party to any tenancy agreement between a landlord and a tenant. We are a marketplace and a service provider — the tenancy relationship is always between you (the tenant) and the landlord.

We strive to verify every landlord on HFR by checking the title deed, the landlord's national ID, and conducting (or arranging) a physical visit to the property before a listing goes live. We call this "HFR Verified".

However, our verification is not a legal guarantee. We may miss fraudulent documents, misrepresented properties, or other bad-faith behaviour. You must always conduct your own due diligence before paying any deposit — view the property in person (or via our video walkthrough), read the lease, and (where possible) run your own Ardhisasa title search.

We may remove, modify, or hide any listing at our discretion, with or without notice, if we suspect fraud, misrepresentation, or a breach of these Terms.

As a tenant, you agree to: (a) provide accurate information when contacting landlords or our concierge team; (b) not use HFR to solicit, harass, or defraud any landlord or service provider; (c) not copy, scrape, or republish listings for commercial purposes without our written consent; and (d) honour any appointment, viewing, or concierge booking you make.

Paying a deposit is always between you and the landlord. HFR is not a custodian of your deposit unless you have explicitly enrolled in our escrow service and received written confirmation of the same.

As a landlord, you warrant that: (a) you own (or are duly authorised to let) the property; (b) the title deed and ID you provide to HFR are genuine; (c) the listing details (rent, beds, baths, amenities, photos) are accurate and not misleading; and (d) you will honour the tenancy agreement you sign with any tenant introduced via HFR.

We may charge fees for verified listings, priority placement, concierge coordination, and property management. These fees are always disclosed in writing before you commit. We do not refund fees for listings removed due to a breach of these Terms.

Our concierge team visits, films, and negotiates on your behalf — but final decisions (whether to rent, sign, or pay deposit) are always yours. We do not sign leases on your behalf without a signed power of attorney.

For property management, we collect rent, handle maintenance, and renew leases on your behalf under a separate Property Management Agreement. That agreement supersedes these Terms for the scope of services it covers.

Where HFR collects payments on behalf of a landlord (rent, deposit, fees), we may use M-Pesa STK, Stripe, Paystack, or bank transfer. These payment processors have their own terms; we are not responsible for their failures, holds, or chargeback decisions.

Refunds, where due, are processed to the original payment method within 7 business days. We are not liable for delays caused by your bank, M-Pesa, or the payment processor.

All content on houseforrentkenya.com — including the HFR logo, design system, copy, calculators, glossary, and templates — is owned by HFR or our licensors and protected under Kenyan and international copyright law.

You may download our free rental templates for personal, non-commercial use. You may not resell, rebrand, or republish them without written consent. Listing photos remain the property of the listing landlord; we display them under a limited licence for the duration of the listing.

To the maximum extent permitted by Kenyan law, HFR is not liable for any indirect, incidental, or consequential damages arising from your use of the platform — including but not limited to a lost deposit, a fraudulent landlord, an uninhabitable property, or a dispute with a service provider.

Our aggregate liability for any claim arising out of or relating to these Terms is limited to the total amount of fees you have paid to HFR in the 12 months preceding the claim.

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall first be referred to amicable negotiation between the parties. If unresolved within 30 days, the dispute shall be referred to arbitration in Nairobi under the Arbitration Act, 1995 (as amended).

If any provision of these Terms is held by a court or tribunal to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
